Sealing Around Fan Vent Pipe

As the pictures show, I need to seal around this kitchen fan vent pipe. Insulation has fallen five feet down the opening which I will need to vacuum out.

Plan is to place drywall within 1/2" of the pipe to cover the opening, then spray foam (orange fire) the gap. Is this allowed?

Yes, the pipe produces no heat like a chimney would. Sealing all around this protrusion is mandatory to keep fire at bay in the lower room, and to help with insulation.
