Not sure where you are but in Canada it is required for 15 amp kitchen counter circuits. It is called a split wired receptacle.Disclaimer: I'm no electrician.
I once ran across a wall plug where the top and bottom were actually wired on separate circuits. I thought it very odd and couldn't figure out what the thought was behind it.
I think what joed is getting at is what are you using to determine the circuit is still powered?Are you sure it's still on? Do lights etc. still function?
simple cut power take breaker out , check with ohm meter if it reads cont. set to off if it still read's than bad, if you don't have a volt meter than i guess just replace breaker , no tools hard to do a jobAn electric circuit is still hot when breaker is set to off position.
