An electric circuit is still hot when breaker is set to off position. Does this mean the breaker is bad or some other problem?
Either the breaker is bad or is being back fed from another circuit. Is this a single or 2 pole breaker?

Turn off the main breaker to kill the panel. Disconnect the wire from the suspect breaker. Turn the main back on. Test the wire for power. Test the turned off suspect breaker for power. If its the breaker, replace it.
If you have power back feeding on the wire, turn of the other breakers until you find the source.

Disclaimer: I'm no electrician.
I once ran across a wall plug where the top and bottom were actually wired on separate circuits. I thought it very odd and couldn't figure out what the thought was behind it.

Not sure where you are but in Canada it is required for 15 amp kitchen counter circuits. It is called a split wired receptacle.

it doubles the current capacity, so the cb doesn't trip when all of the crock pots are plugged in for thanksgiving.
