I am getting a house built and there are few wall cutouts (see through it) throughout the house. I requested builder to install energy efficient fluorescent downlights (13w, warm globes) in each cutouts.

The builder just installed normal downlights saying it is illegal to installed energy efficient fluorescent downlights in wall cutouts.

Another electrician said it is possible to install downlights as I requested.

Is it true that it is illegal?

It is probably a clearance issue.

Fluorescent Lighting Clearance

Clothes closet luminaire (light fixtures), fluorescent style, must maintain a clearance from the edge of that luminaire to the back and side walls of 18" from the edge of the fixture to the back and side walls. You must also maintain 6" from the edge of the shelving storage area to the edge of that luminaire. The 18" clearance must be maintained from the fluorescent fixture whether there is a shelf present in that closet or not. NEC Article 410.8.A and NEC Article 410.8.B.2 and NEC Article 410.8.D.2
