Moved into a new house. The garbage disposal switch also controls power to the dishwasher, which is problematic. What do I need to do to remove the dishwasher outlet from the switch and have it permanently hot? Attached pics of current wiring situation. I'll also be changing the DW outlet to GFCI.

Can you find where that NM cable running out of the diswasher receptacle box goes to? The pictures don't jibe for that connection and it may go to some juction box that will allow changing it to always hot.

If my understanding of the code is correct, that NM (Romex) will also have to be replaced with metal flex or routed so it stays in the wall.
Only required if the cable is subject to damage. And that is a subjective decision. I say it is not but someone may say it is. Certainly nothing I would change.

It's exposed under a sink. I'd reroute the cable so it stays in the wall, or move the box over to where the cable comes out of the wall, but I'm overly cautious with electrical anywhere around water.
