Hi everyone- I've been around here for a bit but this is my first post and I really hope someone might have knowledge they might share with me.
Basically I started working with an unlicensed contractor and executed 3 agreements with him. One of interior work, another for a fence, and one last one for exterior work. Everything went fine at first but when we started working on the fence he started getting really sleazy on us. He's already completed and we have paid for the 1st contract for the interior work, although it was not done to our satisfaction. The fence however is the real issue- we paid in full and are happy with the job done, but now we have subs threatening us because he has not paid them.
We would like to cancel our last contract as we are rightfully dissatisfied with his completion of the first 2 due to quality and the sub issues. The contract is a standard bid form and has NOTHING in terms of info on who/when it can be canceled. He has not started the job and has not ordered any materials. Can I cancel without risking him suing me? I have given him a small deposit- but don't mind losing it for the peace of mind.
Basically he has not breached this individual contract in any way- but does his breach of the others give me a right to back out on this one?
