I want to put in an 70 amp subpanel on my second floor. It's about a 55ft run from the basement panel.

Initially I thought #4 romex would be sufficient (I see they limit the romex to 60°C now and Table 310.15(b)(16) shows that #4 is max 70a at that temp), but all the #4 romex I can find has a ground wire at #8.

Is that OK that the ground wire is sized smaller?

The ground wire can be undersized. Make sure your total run protects the cable. If it does not, and it is exposed in an area where it may become damaged, you may want to consider conduit and THWN wires for the run.
