Changing the banister on stairs

Hey folks -

So I want to remove a 30 year old wrought iron banister from the stairs and replace it with wooden newels, balusters, and handrails. The stairs do a 90 degree turn to the right at the bottom and there is one more step down to go into the foyer (see photo).

How close to the wall can the leading newel be to the wall directly across from it? The wrought iron banister begins at 36 1/2 inches from the wall. From what I understand, the newel will need to be at least 36 inches from the wall to be up to code.

Thanks!!!
