Basement insulation R Vaule

I am still in the planning stages of my basement bathroom install. I had asked the county inspector what is required to be up to code. This is his email

"The answer depends on the exposure of the basement walls to the exterior.
R-5 is required except the walls that are more than fifty percent above grade shall be insulated as a wall – R-13".

My basement is fully underground except for about 1 foot is above the soil. With that I will be to code using R5?

You may want him to clarify that answer. Your frost line is about 20" where you are.

Total wall area in square feet divided by amount above grade == % above grade. Frost depth was not mentioned in your post and is generally below grade.

I doubt your codes are more lenient than ours and as I understand the rules basements must be studded up with 2 x 4 walls here.

Home HVAC systems are rarely sized to heat an unfinished basement.

Insulation is relativity cheap and its use is generally a 'no-brainer'.
