Is this a duplex?
Why do you need to use "their side" ?

You need to be more explicit please.

Does he not want them to walk on his/her grass?

Are two homes so close together that debris may fall on his property?

etc...

They are trying to tell you that all the work on a roof can be, and usually is, done from right on top of your roof.

As long as the roofers have access from 3 sides they should not need access from the 4th side
Actually only front & back should be needed depending upon what needs to be replaced

Well, it is their property
They do have the right to refuse use of it for roofing your house
They may be concerend with possible problems if someone were to fall on their property/or while accessing your roof from their property

Your roofers should be able to work around this

What did they say when you talked to them?

Find a new roofer who can do it
Better to always tear off the old shingles

Get other bids.
Contact your local building code dept.
Contact your state's attorney.
Demand that he remove his gate.

You have the right of egress to be able to fulfill your building requirements.

Contact someone in the village hall code department and ask your question and they can force him to allow the work temporarily on his property.

I would detach that fence the very next morning too.
