Im putting a three piece bath in the basement and was wondering is it to code that a rubber membrane has to be installed under the tiles in the shower, even though its in the basement?

"Three pieces"?

What are the three pieces?
Is this a tub surround?
Where do you live?
Why would a basement matter?

The membrane is the prevent leakage to the floor under and below in the event of tile grout failure, not an issue for you.
