Toe Touch stopper cycling up and down?


Hi, I installed last month a brand new Mirolin acrylic bathtub, with a brand new drain assembly using a Toe Touch drain stopper. The thing is that when the bathtub is full, if I open the stopper to drain the water, it start going up and down at a 1 second cycle and doing a loud annoying pumping noise. But if stops when water level goes under half of full level and then keeps draining normally, what's going on?

Sounds to me like it's not venting.

It's not possible, the drain is just against the overflow pipe, this is all brand new so there is no blockage. I think is just a too weak spring at the touch toe, but I can be wrong.
