does this toilet need to be replaced based on rust?
moved out of an apt, toilet inside was rusted. It rusted REAL easily over the year, even with periodic, though not super regular, cleaning, and the city has really hard water which I heard can contribute.

Anyway, my landlord says the entire toilet needs to be replaced. Everything works fine with it, just the rusted condition. Here are some pics of the toilet . Let me know if she is right or if some sort of cleaning method/cheaper solution can fix the problem. Also what do you think a new toilet cost would run?

Thanks, much appreciated. First picture provides the closet view, second/3rd taken from farther out

Is your landlord asking you to pay for the replacement?

It really all depends on what your lease says. Landlords tend to have discretion at determining what "damage" has been done and what you are responsible for. This will be especially so if you never notified the landlord that it was happening. At the same you can argue you are only responsible for the cost of the current toilet. If it's older that's not much. If it was new and especially nice it may be quite a bit.

My advice would be read your lease really close to see what it says and try to be as cordial as possible while you two work out a solution. Landlord / tenet arguments can get mean but you being nice and cooperative will go a long way. (To a point, don't get pushed over.)

yes, she is asking for a full replacement fee of the entire toilet unit.

Your pictures did not come through.
You would have 0 control on the iron content of the incoming water, It was up to the landlord to profide a water softner.
I'd bet he already knows of the condition and after every move out has had to go in and get rid of the rist in toilets, tubs and sinks.
Anyway to get a water test to prove your point in court?

Tell the landlord to take a hike. She should reimburse you for not having properly treated water.
Just curious, what does the tub and sinks look like?

Out of curiosity, does the landlord have a deposit she is threatening to withhold or is she asking you to fork over money?

she has a 1150 security deposit.

do these pictures work?

Then I still stand by what I said. Read your lease closely to see if you have any options here but you're probably out of luck.

Nicely ask if you can have the chance to clean it first. If you can't or it doesn't work try to be proactive about finding an affordable replacement.

I still could not get the pictures to come up, may just be my computer.
A bottle of The Works for $1.00 from the Dollar store and a prumis stone most likely can make it look like new.
I can Buy a cheap toilet all day for $100.00, a good one for $200.00 and might take an hour to install if I'm being lazy and feeling slow.

There is no part of a toilet that rusts, except maybe the flange bolts at the floor. It's her water and negligence in treating it that seems to be causing it.
And yea, pictures didn't work. Why not upload them here on the forum site?

Any judge would laugh them out of court. As you said it's rust, it's from poorly treat water or old steel pipes, nothing to do with your resposablitys.
There trying to get something for nothing.

can you guys see my new pictures? I want to make sure its actually rust and not some stain I caused of anotehr nature

BabsHoney 08-15-2012 10:36 PM

Now that I see pictures I think that toilet just needs cleaned. Then again I can't get the pictures to load any bigger so I may be wrong.

I should say, I don't think you should have to pay for it, I never thought that.

What I am saying is she already has your money. Unless you can reason with her she'll just take it out of your deposit.

Going to court would be on you. Are you really going to bother with it over $200?

That's why I was saying just try to be nice and cordial and find a solution that works for both of you.
