bathroom faucet pop-up lets water go down

My plumber installed my new Delta Dryden faucet with the pop-up drain. Problem 1 - When the pop-up rod is pulled up, it does not keep the water from going down when there's water in the sink.

Problem 2 - When the water is running with the pop-up down so the water can go down the drain, after the sink gets filled 1/3 or more with water, the weight of the water makes the pop-up "pop up" even if not pulled up in the pop-up position, and the water can't go down normally and only drains extremely slowly. My plumber said the pop-ups never work - but all mine have in the past.

insist that your plumber to come back and fix it or supply a different pop-up. You're right, they do work
