Basement branch vent connecting below flood rim of main level fixture


I live in an NSPC jursidiction, which, unless I've misinterpreted the code, allows me to connect to a vent below the trap crown weir as long as I size up the drain beyond the trap and as long as I connect within the code specified distance.

I believe my diagram is correct except for the branch vent from the ejector pump that ties into the vent stack below the flood rim of the first floor kitchen sink. Please let me know what you think. Click the link to open the attachment - - ->

The inspector says that branch vent connection below the kitchen sink flood level rim is a no-go. I'd be willing to take the risk of a blocked drain running the ejector constantly, but I will comply with his decision.
