What would you do to the guy who does this?

Best idea of punishment gets $500. Obviously he didn't know what he was doing, but then again why notches are perfect cut?

Hung by the neck but still living, have the guts removed and burned before the still living eyes, remove the head and split the body into four pieces to be located where ever the sovereign deigns fit.

Ooops. That was at 16th cent punishment for treason.

have you ever seen that neat little "tool" where they would slit the belly open, grab the intestines and attach to this little crank thing and slowly wind the intestines onto the spindle while the person got to lay there and watch?

Get to the punative punishment later, but now, hopefully the culprit is still around working on the house, and you owe him some money. These joists need to be string lined from plate to plate and jacked until the are straight again, then sistered. Full width plate to plate if possible, if not, as long as posible, and bolted together with 1/2" bolts. I agree, the notches look fairly fresh, but the joist directly in front of the drain pipe already has a clearly visible sag in it. The water stains on the joists lead me to surmise that there is a bathroom above, making a plumber the most probable culprit.
As for punishment, I suggest the old method farmers used to use to castrate hogs. A wire just like rebar ties was twisted around the testicles, cutting off blood supply, and they just died and fell off.

Since there doesn't seem to be a question on DIY I'm moving this to Off topic

Cut equal sized notches in his legs and see how much they like it. Would probably be just as instable as the notched joists....

Looking at the holes that had already been drilled and the pipes that are hanging below the joists to the left, I'm betting someone was going to relocate the those pipes to install a ceiling when their drill bit got dull or ran out of clearance and opted to just notch the joists instead. Probably just took a circular saw set at 1 1/2", made two perpendicular cuts and whacked the notch out with a hammer. I'd do as suggested above and get them repaired before they sag further.

Hey! Look on the bright side of things. At least he didn't just cut all the way through it without giving any alternative means of support like someone did in my bathroom:

Anyone caught doing this, or the OP's job should be encased in poured concrete - while still alive!
