I'd say its pretty willfull that they ripped the roof off

If its a mistake you fix it
They haven't, arrest them

Removing the roof was willful but that is not what they are referring to. The injury is what they are speaking of being willful. The guy did not intend to injure the guy. It was a mistake.

and no, they cannot be arrested if they do not fix it. This is a civil action. There is nothing criminal about it.

I don't know if you are arguing as a joke or simply because you are just not understanding the situation. The fact is; there was no criminal act so the police are not going to arrest anybody. On top of that, the police have very limited action as to who they can arrest. This would not be a situation where the police would make the decision anyway. IF there was a possibility of a criminal action, the DA would be the entity that would seek an arrest warrant. The police are not going to make an arrest in such a situation without a warrant.

Fine Dave. I'm sure we will read about the Department of Homeland Security in conjunction with the FBI and the NSA in a joint action with the Florida State Police and local police where they arrest the owner and employees of the roofing company. Be sure to post that up here when it happens.

I love how it's never anybody's fault!! When mistakes are made, companies ( and their insurers) need to step up and fix it, instead of pointing fingers and looking for an easy way out.

I'm not sure if you could charge anybody with vandalism, and even so it's probably not going to land anyone in jail. Tresspassing would be a much easier charge, but again, I doubt anyone is getting locked up for it

The weird thing is the Roofing company has publicly admitted fault & that they made a mistake
That means any lawsuit they would automatically lose
They just want some $$ from home owner/his insurance company, which is crazy

Well, arresting them all is still not going to get the guy a roof on his house.

My prediction? This causes the roofing company to belly up in face of bad press and resulting drop in business. In Florida they will be able to keep most if not all of their assets---certainly all the tools of the trade. They will change their name and be back in business in a day or so. The poor guy still has to cough up the moola for a new roof! There will be nobody left to suit in a civil action to recover his costs.
