Permitting- What exactly is a Notice of Commencement?


Renovating my kitchen. Figured do it right- apply for permit for the electrical reconfiguration. Town hall homeowners permit form speaks of Notice of commencement-

"Your failure to record a NOC mat result in your paying twice for improvements to your property".

Now, I "started" ripping of the yucky ole cabinets and stuff- but no serious elec work done yet. Have yanked some elec outlets as well. Am I in big trouble because I didnt tell them that yet?

What do they mean by "paying twice". Im doing all the work!! No ones paying me.

Paying twice is the fine for not notifying them. I would call them and ask what the NOC is about. I suspect you just notify them you are beginning the project.

worst case scenerio- they fine me for that- whats the typical/usual fine for this technicality?

My guess is once you have an approved permit in hand, you're supposed to notify them. Maybe at that point they inspect either your plans or the premises so they can approve what you're doing too. If all goes well, they issue a Notice of Commencement and you can begin the work.

That's my best guess without having the Association's rules in hand.

Most people are lazy and they may just inspect your plans and make sure you have a legit permit. I changed out a third floor attic to a liveable space for the kids and built a spiral staircase, w/o permit or permission from the Association. When I sold the place, the only comment I got was from the realtor and new homeowner, who both loved the addition.

'A “Notice of Commencement” must be filed with the Clerk of the Court (County Records Division) prior to commencement of construction of a project, and a certified copy or affidavit attesting to the recording of the Notice of Commencement, must be posted at the jobsite. This notice contains detailed information about the project such as property owner, financial institution, jobsite address, contractor, etc., and protects the property owner’s title to the property.'


any contractors then are supposed to file a 'notice to owner' based off of that notice of commencement, stating they are performing work on that particular jobsite. This is more for contractor protection from non paying owners, it would allow them to file a lien against your property. If you pay a contractor that filed a notice to owner without getting a 'release of lien' from said contractor. You could be forced to pay 'twice'(One original payment, again to remove the lien).

Wow, glad I don't live where the OP does. Never heard of such a thing. Just more bureaucracy to take your money.

Is your house located in an historical district? Now those people can be a real pain in the ass. You can't fart without there approval.

Thanks, people. I feel better now. Tomorow I cut slab in concrete- they cant get mad for that, I figure. Im not doing elec work yet.......just preparation.
