you old timers with your cataracts and all, I thought it would help.

i didn't realize it was going to be so big, even took me for a loop.

As I see it, you don't need a permit, so you probably don't need, and don't have, any plans for the deck. So as was previously pointed out, it is difficult to understand what design basis you are going to hold your contractor to. There are at least fifteen items required by the Prescriptive Deck Code that your deck does not meet, but the deck code is not applicable in your case, since there is apparently no building code where you are. So it would be a difficult case to ask the contractor to install the deck in accordance with a code that is not applicable.

It would be a totally different matter if you had a contract with the deck installer saying that your deck had to be installed in accordance with the Prescriptive Deck Code. Maybe next time you will consider writing that in to the terms of the contract. If you want the contractor to go back and install the deck in accordance with the guide, the contractor would likely be 100% within his rights to require you to pay to dismantle the deck and reconstruct it in accordance with the guidelines. So probably you are stuck with it the way it is, unless you want to dismantle the deck yourself and rebuild from scratch in a deck code compliant way. I understand your issue with the deck construction, unfortunately it is hard to know where to stop once you start criticising the installation.

If you don't have building codes try the Life Safety Code. I think that is national not local. If they don't cover it try having your insurance agent look at it. If it doesn't pass their inspection you might be able to file a claim against the contractors liability insurance. Did the company that built the house give you a Right of Rescission, (federal law), when you contracted them? If not ask them for it. After they give it to you, you have 3 days to cancel the contract. That is a lot of leverage to make them make things right.

How upset should I be?


Thanks for all the feedback guys, I work weekends so I haven't really done anything yet. I have a few ideas that I will pursue later in the week. The deck $2,000 addition to the project, I might have to just suck it up though. I told him to stop working on it until we spoke and he finished it anyway so he must think he has the stronger position contractually. What I would like to do is tear it off the house and dump the pieces in the builders parking lot.

Carriage bolts instead of the nails. Don't give him any more money till it's done right. Is this guy even licensed? That just looks horrible. Remember, the guy that holds the money, has the power.

Haha, it was billboard sized, you could see that photo from across the street!

You might try imgur.com for free upload or paste fro clipboard photo hosting, use the "large thumbnail" link it provides and that's usually a good size for forums and blogs.
