Bathroom exhaust vent location

Hello all. I've read several threads on this topic but am not clear whether any of the replies are related to the IBC 2009. I'm planning on venting a top-floor bathroom vent through the soffit (this is new construction and will be inspected). It would terminate in a circular screened fixture that's flush with the soffit board. Our contractor, who is working on other aspects of this project, insists that the IBC 2009 only permits bathroom venting through the roof or a gable wall, and not through a soffit. Anyone know whether he's right on this one?

Don't have an answer, but you could just ask him to show you the code, or call your local building department and ask them.
