Pool Contractor Problem
 
I recently chose a pool company to do plaster resurfacing at our home. The owner said he would bring over a contract, we received none, but were asked to sign the quote. Our reply was that we wanted an actual contract.

Upon returning from work the next day we found that our pool had been drained. Upon contacting the owner, we asked that we still get a contract to sign. Work continued on the pool without a contract regardless of repeatedly requests. What I expected, as per other contractors was a terms of the agreement, stated warranty, estimated completion date, addendum to enhancements that were requested (quartz additive), & payment terms. I asked for these to be stated in writing via multiple conversations.

On July 21st, I drafted a sample contract based on some web contracts & faxed it to his office. My cover letter stated that he could edit my document, but if he would sign the agreement, I would give him his down payment. He responded by calling and telling me he would not sign this contract, would not put in writing the terms I requested, would take my contract to his attorney and charge me for the lawyer's time. I said I would not pay for his attorney, & he responded by yelling & cursing at me, then telling me he would put a lien on my home, quit the job and come for his money. After an estimate from another company to complete the job, I agreed I would pay him fair compensation but he responded by yelling & cursing then stating he would be at our house to get his equipment and in the morning to get his money. He then procede to steal our remaining good tile (that is hard to find).

At this point, I don't know what to do. I have filed with the BBB, but don't want a lien on my home, want my tile back, and am pretty stressed over this. Any idea on how to procede? Thanks for reading the long thread.

I think you need to ask the guy what does he want and come to a fair settlement for the works he did on your house and state that you want your good tiles back...

hope you two can come to a mutual agreement...

Here is a term contractors use...its called "lawyer up"...you should contact an attorney immediately...and document everything you can, including your phone calls to his office....good luck.

Kev. The conractor probably can't lien sh*t without a contract. If you didn't agree to the terms, price, etc. then there's no 'meeting of the minds' and he likely doesn't have a leg to stand on. Also, a lien doesn't mean squat unless you want to sell your home.
Cough up the $500 bucks it'll take to talk to an attorney and have them send a letter to that yahoo you tried to hire. Yelling & cursing? Tell him you're going to file assault charges if he doesn't shut his yap.

I have a question. WHY did you let him keep working???
I would have said DO NOT START until we reach an agreement.
This guy sounds like an a-hole!

I know this is hindsight, but come on.
