pizza place - Use A-Assembly vs. M-Mercantile

Existing building - previousely was a real estate office, converting it into a pizza place. A restaurant is considered an assembly space - but the 2006 IBC states that an assembly space with less than 50 occupants is a type B-business clasification - huge diference for us (type B means no change of occupancy and we don't have to upgrade anything we arent directly altering) - if we switched to A we would have to add more exits and provide separate mens and womens restrooms.
The issue is that there is the main dinning area (assembly), and then there is a separate small take our area (which the inspector is calling assembly and myself and the engineer/deisgner are calling mercantile).
The occupancy load of this take out area is crucial, because if it is an assembly space it has to accomodate for 22 occupants - putting us just over the 50 occupant limit for us to remain a type B-business occupants. If it is a mercantile use we only have to accomodate for 8 and everything is fine.

After meeting with the inspector they are reluctant to change their mind - even after a conversation with a licensed engineer. they said they wont change their mind based on our argument and to try submitting a formal argument.

just looking for any input - or any written evidence or precedence that can be submitted to help with our argument.

im with the engineer - i have to prepare the argument with suffiecient evidence for our case.
