Wire gauge for electric water heater?

Helped a buddy replace WH today. WH was in garage and made for an easy job. When I disconnected the electric feed to the WH I noted it was #12 THHN in Flexible Metal Conduit from a JB above the WH. Opened the JB and the THHN was connected to 10-2 NM coming out of the wall (Circuit breaker was a 2 pole, 30 amp).

I was not comfortable leaving it as it was so I went to a supply house and bought some #10 THHN and pulled that into the FMC.

Is there any way the #12 was code compliant? WH (old and new) has 4500 watt elements. Could the #12 in the FMC be considered a fixture whip?

You were right. #12 is not compliant there.
