Lights in same joist space with water pipes - Code violation?

I'm doing some remodeling in my basement and want to add some recessed lights. When I cut open a hole in the ceiling to put the cans in, I found the hot and cold lines for the bathroom in the basement. They are running in the airspace between the 2 joists, not perpendicular to the joists.

Is it a code violation to have the electrical boxes and lights in the same joist space as the water line? Does that circuit need to be on a GFI breaker?

If either the lights or the pipes need to move, then so be it, I just want to do it right.

Your ok, just dont let the recessed can touch the plumbing, particularily if it is copper. Insulate the pipe if its too close.

Outstanding! Thats the answer I was hoping for. I was going to insulate the pipes anyway. Thanks.
