Kitchen Recessed Lighting is it Dangerous

My husband bought 5" recessed baffel kit lights for our kitchen, but they are not Iinsulation Contact. The height of the housing is 5.75" we have 7" of clearance from the kitchen ceiling to the bottom of the second floor. my question is is this dangerous to install because there is only like 1" clearance, and is it ok to just push the really thin layer of insulation back 3" away from the whole recessed light help. He wants to install today HELP.... what to do....

Normally, there is no insualtion between the 1st and 2nd floor, which would make non-IC fixture OK. If there is insulation, Definitely use IC rated fixtures.

Those spaces between floors can be drafty, I prefer air tight fixture.
