Double box two circuits - code violation?

This is one of the many strange things I've found in this 50 year old house. I have a double box in the kitchen that has an outlet and a switch that controls some overhead lighting. I discovered that the switch and the outlet are actually on different breakers!? Is this a code violation? I could see how this could fool someone into opening opening up a hot box. If it's not to code, what's the fix?

This is not a code violation. It can actually be required as lighting cannot be on the small appliance branch circuits. This could also happen with lighting and the disposal circuit in one box.

The proper thing to do is to always check for power before working in any box.

Thanks. I just found it odd because I've never run across that before. That will save me the effort of putting in another box.
