cold air code

My oil burning furnace is located in my attic directly above my living room. it is 24 x 30" My heating duct for my living room blows right into it(4 ft away) Am I just throwing money away? Also the cold air return is almost directly above my woodburning fireplace, is this against code? I read somewhere it has to be more than 10 feet away any ideas? I have a small ranch house sitting on an uninsulated crawlspace in the snow belt in ohio. HELP
