what kind of bush is this and why does it look so bad

I dont' know what kind of bush it is, but those dead areas generally happen when they don't get enough light.

If you want to keep that bush, you'll probably have to thin out surrounding bushes.

From what I can see, I think it maybe a privet or varigated privet (green and white leaves); is it covered with tiny little white flowers in spring? They do best in sun, but even so, the bottom branches tend to get leafless and need to be trimmed off as it grows. Since yours is bare pretty high up, is there a structure or big tree shading it?

Yep, that's what it looks like, a varigated privet. There's nothing really shading it but there was a long period of cloudiness in our area lately. It's not cloudy anymore but the spareness remains. Not sure what to do...

The summer before last was a dry one. A local florist told me my privet needed more water. I was all set to run the hose out to it this past summer but it rained pretty much all summer which was a bummer for us but brought the privet back nicely.
