Bad pool installed?

I went to a local pool company to finance a pool , two days after going they sent it to their finance office and they wanted a payment , equity one ... I had no pool installed and told the finance comp. they said I signed the contract it was binding ., I called pool comp. they came out to my house three weeks later installed the pool when I was not home damaged my yard, and then walked off the job when I asked them to fix it , I called the finance com, who tried to get the pool com. to come out and fix it , the finance com , then went on to say the pool was mine free and clear... I did not hear from any of them for over a month and hired others from aquabot to finish the pool . The finance com. has since filed suit, I retained an attorney who has not been much helpful. My credit has since been ruined. I offered to pay for the work that was performed but the finance com, wants all the money. even though there was a breach , they are making it out that they were victimed and I was stiffing them

when someoone said it is "free"... normally it is not a good sign... when you said it damage your yard... is it only cosmetic damage with some grasses being taken off... and everything else include the pool was installed properly and functionly... if this is the case... you may be on the wrong side of the story.... at least you should have started the payment and continue to pursuit works to be done on your yard... rather than don't pay a cent...

If it was just normal damage to the yard to get the pool installed its in most pool contracts that will happen. Even up front if you want it turn key when done they will do it, but add in the cost. Was the pool installed to code etc. ??

I'm having a little trouble understanding your first post.

Are you saying that you inquired about a pool, applied for financing, but then decided not to go through with it? Then while you were out of the house, the pool company came and installed a pool you didn't want (damaging your yard in the process). You called the finance company, and they told you that the pool was yours for free without you making any payments on it? And now your credit is ruined and everyone is suing you?

Could you explain it a bit more? What happened between them telling you you get a free pool (which seems like an unlikely thing for the finance company who just paid for the pool to say), and them suing you?

I'd agree that you need a better attorney, or you need to be more clear on what you signed in the beginning. If you agreed to finance a pool, and they installed it, then the best attorney can't help you much. But if you actually didn't agree to buy a pool, and they did it anyways, then I'd say your attorney should be helping you through this.

Sounds like a headache either way. Good luck with it.

I believe what was said was this:

Inquired about a pool,
Setup financing

Pool was not installed, they asked for money.

Pool installers finally came (3 weeks later)

Botched the job, left it unfinished, and damaged the landscape.

Couldn't get them to come fix it.

Finance company couldn't get them to come fix it.

Finance company said "it's yours free and clear"

Hired someone else to finish the pool.

Later, Finance company files law suit.

The rest is unfolding...

Aye, you need a better lawyer, and perhaps to explain some of the details a little more clearly.
