Fieldstone walkway


We currently have a mason working on a 300 sq ft walkway of wed laid irregular flagstone, including some stairs and a landing.

We are paying a lot of money to have this done, and there's a couple of questions I need a reasonability check on.

1. The original pricing included more stairs than could actually be accommodated due to the grading. Should we be expecting a price reduction for less stairs?

2. The mason bought 3 full pallets of fieldstone to be used on the walkway. He just finished laying it out, and there was a pallet remaining. He packed it back in his truck and took it with him. Who owns the remaining fieldstone? Should we get a discount due to the remaining fieldstone?

We have had a few problems on this project and are now starting to feel like we are being taken advantage of. Since we've never had a project like this done before, we really don't know if our expectations are unreasonable or if we should be expecting price reductions since they didn't use all of the materials specified in the contract.

Can anyone provide any insight on this? Thanks!

If you paid for them then there your's and if he removed them from the job site without your permission then there stolen.

We actually didn't purchase the stone directly, the mason did. Does that mean he owns the leftovers?

what does your contract specify? did you pay for the entire job up front?

When laying flagstone, really any true stone work, I always figure a fair amount of material overage. I pay for it, thus I own it. I could buy just enough to "cobb" the job together, but i buy extra to offer good selection and decrease the time it takes us to complete the job. SO, in short, unless you physically wrote a check for the stone material, NO, the balance of material is certainly not yours...............

If you're interested ask the contractor if they will sell you the additional material for a nominal fee...........

Thanks for the response. The contract quoted a fixed price for the walkway, we did not buy the materials separately.

That response totally makes sense, since this is our first time contracting with a mason, we really had no idea of how it works with materials, etc. Since we've had problems with the mason, we didn't know what to think.

As an aside, they are starting to wet lay the fieldstone today, how he pieced it together looks fantastic.
